Ii. Requirements for Food FDA Certification
According to the Anti-Terrorism Act passed by the US Congress in 2003, all foreign companies exporting food (and animal food) to the United States must register with the FDA. If they are not registered with the FDA, the products of these enterprises cannot be landed in the United States. The enterprises referred to here include food enterprises engaged in production, processing, packaging or storage, etc.
Iii. Why is FDA certification required for food exports to the United States
In 2002, the Public Health and Safety and Anti-Bioterrorism Prevention and Response Act (Bioterrorism Act) instructed the U.S. Food and Drug Administration (FDA), the food regulatory agency of the Department of Health and Human Services, to take measures to protect the public from threats or actual terrorist attacks on the U.S. food supply and other food-related emergencies;
In order to enforce certain provisions of the "Bioterrorism Act", the FDA has formulated the following regulations:
1. Food is registered with the FDA;
2. Notify the FDA in advance of the shipment of imported food.
These regulations came into effect on December 12, 2003.
Iv. The Role of obtaining FDA Certification for Cookie Exports to the United States
According to the provisions of the U.S. laws set out in the "U.S. Federal Food, Drug, and Cosmetic Act", food importers aiming to introduce products into interstate commerce in the United States are responsible for ensuring that the products are safe, hygienic, and labeled in accordance with U.S. requirements. (All imported food is considered interstate trade.)
2. The FDA may impose sanctions on individual food importers, products, labels or goods without legal authorization, approval, certification, licensing or other means. As long as the facilities for the production, storage or other handling of the products have been registered with the FDA, the importer may import food into the United States without FDA approval and provide the goods with prior notice to the FDA.
3. Imported food must be inspected by the FDA at the entry ports of the United States. If it is found that the goods do not meet the requirements of the United States, the FDA may detain the transportation of imported products. Imported and domestic food must comply with the same legal requirements in the United States.
4. Food FDA registration is a registration for enterprises. Each enterprise corresponds to a registration number, and there will also be records of relevant food product information produced by the enterprise. As long as the food enterprise has registered an FDA number, all the food it produces exported to the United States can use this FDA registration number, which is universal. Therefore, a food enterprise only needs to register once and apply for one FDA registration number. However, it is necessary to pay attention to the later update of registration and maintenance; otherwise, it cannot be guaranteed that the original FDA registration number will remain valid for a long time.
V. The FDA certification process for food-grade materials is as follows:
(1) Consultation - The applicant provides product information pictures or describes the products and materials that need to be applied to the FDA.
(2) Quotation - Based on the information provided by the applicant, the engineers of Hengda Testing will make an assessment, determine the items to be tested, and quote to the applicant.
(3) After confirming the quotation, the applicant shall fill in the test application form and the test samples.
(4) Sample testing - The testing will be conducted in accordance with the applicable FDA standards;
(5) Provide the FDA-certified report after the test is completed.
